Tesla’s UK lawsuit for 5G patents licence thrown out by UK court

US technology firm InterDigital and the patent licensing platform Avanci successfully defended against a London lawsuit filed by Tesla (TSLA.O) on Monday.

The lawsuit, initiated by Elon Musk’s company in 2023, sought to obtain a patent license for the anticipated launch of 5G vehicles in the UK.

Tesla’s legal action aimed to have London’s High Court determine fair, reasonable, and non-discriminatory (FRAND) terms for using patents owned by InterDigital and other patent holders, which are licensed through Avanci. According to court filings, Tesla planned to launch 5G-enabled vehicles in the UK imminently.

InterDigital and Avanci, however, requested the court dismiss Tesla’s bid for a FRAND license ruling. On Monday, Judge Timothy Fancourt ruled in favor of InterDigital and Avanci, stating Tesla’s request for a license determination must be dismissed. Nevertheless, Tesla’s claim to revoke three of InterDigital’s patents will proceed.
