The Judge in the case instituted by Maryam Sherif, a divorced wife of Alhaji Atiku Abubakar for custody of their three sons, Hon Bashir Danmaisule, has ordered the three children be brought to the court anytime the matter comes up.
Abubakar, who is the son of former Vice President, has custody of the children.
The judge also ordered the defendant to ensure their final witness is in court and they submit their final address on the next adjourned date, October 13, 2020.
The plaintiffโs counsel, Nasir Saidu, had in the last sitting, prayed for the three children to be brought to the court anytime it sits on the matter with case number CV/16/2020.
This was objected to by the defendantโs counsel, Abdulahi Hassan, who argued that the plaintiff was free to visit the children anytime.
As the matter resumed at the Upper Area Court in Kubwa, the plaintiffโs and defendantโs counsels were to submit their final addresses, but the defendantโs lawyer, Hassan said he submitted a motion the previous day to enable them to present their final witness to the court.
The plaintiffโs lawyer, Abdulateef Mohammed, who represented Saidu, said they were only served the notice in court and prayed that the defendant is foreclosed in the matter, as it was a ploy to waste time.
The judge declined the request to foreclose the matter and ordered the defendant to ensure their witness and final address are ready at the next sitting.
