Court adjourns Adeleke certificate suit till Monday

An Osun State High Court sitting in Osogbo, the capital, yesterday adjourned till August 6 proceedings in the certificate suit involving Senator Ademola Adeleke, the Peoples Democratic Party (PDP) candidate in the September 22 governorship election.


Justice David Oladimeji gave the order to enable parties access documents.

Two PDP members had approached the court for an interlocutory order setting aside the election of Adeleke as PDP governorship standard bearer over alleged non-submission of his secondary school certificate.

Adeleke was declared winner in the PDP primary on July 21 after garnering 1,569 votes to beat his closest rival, Dr Akin Ogunbiyi, who polled 1,562.

But the plaintiffs, Rasheed Olabayo and Oluwaseun Idowu, in the suit filed on July 24, sought an interlocutory order to set aside the election of Adeleke.

They argued that he did not satisfy the constitutional requirements to contest the governorship election.

Oladimeji urged the counsel to take the interest of the people into considerations in whatever resolutions they reached, to forestall any erroneous information that may heat up the polity.


Counsel to the plaintiffs Mr Olufemi Ayandokun had told the court his clients were willing to settle due to their love for the party.

Ayandokun also said the parties, especially Independent National Electoral Commission (INEC), had not been served the documents.

Defence lawyer Edmund Boriomoni said the matter before the court was the hearing of a motion on notice concerning an interlocutory injunction.

Borromini noted that a counter-affidavit has been filed to the application against his client with a notice of preliminary objection challenging jurisdiction of the court.
