The State Police in Middletown, said that 35-year-old Nicholas Barba of the Bronx, was playing ball with his son on the shoulder of the highway before he was killed.

The driver who ran over the father, stopped and waited at the scene until police arrived. No charges are expected to be filed.

Barba called a tow truck after his vehicle was disabled on the shoulder of the highway. While waiting for the tow truck to arrive, Barba was throwing a baseball around with his son.

When the ball landed on the other side of the median, Barba decided to retrieve it. As Barba was crossing the eastbound lanes, he was hit by a speeding car.

Barba was taken to the Orange Regional Medical Center, where he was pronounced dead. Barba left behind his wife and three children.
