Abad pleaded not guilty to one count of sexual penetration of a child
under 16 years old, saying that he believed the girl when she told him
that she was 17 years old.
According to the police investigation, Abad met the girl at the
Melbourne Children’s Court, during a custody hearing. Abad invited the
girl to smoke a cigarette together outside, and they exchanged phone
numbers.
Ten days later, Abad picked up the girl, who was under the care of the
Department of Health and Human Services, and took her for a ride in his
car, where they embraced and kissed.
The next day, he asked her out for dinner and a movie. He then took her
home and had sex with her. For the next few weeks, they had sexual
encounters.
Eventually, the girl told a welfare officer at her school that she was
having sex with an older man. The welfare officer contacted the police,
who detained Abad for questioning.
During questioning, police informed Abad that the girl is only 14 years old.
When Abad went home, he told the girl that their relationship had to
end, but they went to his room and had sex for the last time.
The girl again told the welfare officer about the sexual encounter, and Abad was arrested.
