Man Bags Six Months Jail Term in Maiduguri for N8.5m Fraud


Justice Aisha Kumaliya of the Borno State High Court, Maiduguri, on Monday, June 28, 2021 convicted and sentenced one Mohammed Ali (a.k.a Daddy) to six months imprisonment for fraud to the tune N8, 550, 000.00 (Eight Million Five Hundred and Fifty Thousand Naira).

The convict was arraigned on a one-count charge of ‘‘criminal breach of trust’’, an offence contrary to Section 311 of the Penal Code Cap. 102 Laws of Borno State of Nigeria and Punishable under Section 312 of the same Law.

The one count charge  reads: “ That you, Mohammed Ali (a.k.a Daddy) sometime in August 2019 at Maiduguri, Borno State within the jurisdiction of this Honourable Court, being entrusted with dominion over certain properties to wit; N8,550,000.00 (Eight Million Five Hundred  and Fifty Thousand Naira) by Alhaji Usman Haruna Zira for the purchase of a Truck of Diesel from Port Harcourt Refinery Company, Rivers State, did dishonesty misappropriate the entire sum of N8,550,000.00 (Eight Million Five a Hundred  and Fifty Thousand Naira) and thereby committed an offence contrary to Section 311 of the Penal Code Cap.102 Laws of Borno State of Nigeria and punishable under Section 312 of the same Law.”

He pleaded guilty to the charge preferred against him by the anti-graft agency.

In view of his plea, prosecution counsel, Muktar Ali Ahmed prayed the court to convict and sentence him accordingly.

However, defence counsel, I.T. Munguno pleaded with the court for leniency on behalf of his client and to temper justice mercy.

Justice Kumaliya, after listening to both parties, convicted and sentenced Ali to six months imprisonment.

He however, gave the convict an option of One Hundred Thousand Naira (N100, 000.00) fine.
