The Economic and Financial Crimes Commission, EFCC, Maiduguri Zonal office on Tuesday, July 09, 2019, secured the conviction and sentence of one Ahmadu Mai before Justice Aisha Kumaliya of the Borno State High Court, Maiduguri.
Mai was an officer II Finance and Accounts of the Yola Distribution Company, Bulunkutu Business Unit, Maiduguri Borno State, before his conviction.
He was first arraigned before Justice Fadawu Umar of the State High court, Maiduguri on a two-count charge bordering on conspiracy and diversion of funds to the tune of N5, 718,049.28.
Subsequently, Mai applied to the Chief Justice of Borno State for change of court.
His journey to the dock started when the Commission received a petition against him by the Yola Electricity Distribution Company, signed by one Mohammed M.A.
The petitioner had in his petition alleged that the disciplinary committee of the company revealed that between July 2016 and July 2017, the accused person used his position to confer upon himself the total sum of over N5m revenue belonging to the company.
At today’s sitting, Counsel for the prosecution Fatsuma Muhammad applied to the court for the amended charge to be read to the accused person.
The Count reads: “That you Ahamdu Mai while being Officer II Finance and Accounts with Yola Electricity Distribution Company, Bulunkutu Business Center Maiduguri, Borno State between July 2016 and July 2017 in Maiduguri within the Jurisdiction of this Honourable Court used your position to fraudulently confer upon yourself the total sum of Two Million Eight Hundred and Sixty Thousand Naira (N2, 860,000. 00) revenue belonging to Yola Electricity Distribution Company and thereby committed and offence Contrary to and punishable under Section 320 of Penal Code Law Cap 102, Laws of Borno State and punishable under Section 322 of the same Law.”
He pleaded “guilty” when the one count charge was read to him.
Counsel for the prosecution, Fatsuma Muhammad, prayed the court to convict him as charged.
But Counsel for the accused person, H. Waziri pleaded for leniency and informed the court to temper justice with mercy as the convict has fully restituted the nominal complainant.
However, Justice Kumaliya, convicted him as charged and sentenced him to six month jail term with an option of fine in the sum of Fifty Thousand Naira (50,000.00).
