The Synagogue Church of All Nations (SCOAN) has lost in its bid to stop its trial by an Igbosere High Court, Lagos
This is because the Court of Appeal, Lagos Division, has dismissed the appeal filed by the church and it’s engineers for lacking in merit.
This was disclosed in a statement signed by Deputy Director Public Affairs, Ministry of Justice, Mr Kayode Oyekanmi.
The statement said the appellate court affirmed the decision of the lower court judge, Justice Lateef Lawal-Akapo delivered on March 9, 2018.
Justice Lawal-Akapo, of a Lagos State High Court had on March 9, 2018 dismissed the no case submission filed by the defendant’s/appellants.
The trial Judge, held in his ruling that the state had established a prima facie case against the defendants/appellants to warrant them being called upon to put up a defence.
But dissatisfied with the ruling of the lower court, the defendants appellants, Messrs Oladele Ogundeji and Akinbela Fatiregun charged alongside their companies, Hardrock Construction and Engineering Company and Jandy Trust Limited , approached the appellate court urging the appellate court to upturn the ruling.
Having considered the arguments of the appellants and the submission of the DPP, Ms. Titi Shitta-Bey, the Court of Appeal dismissed the appeal for lacking in merit.
