A drunk driver who suffered severe injuries following a car crash, filed
a lawsuit against the bar that served him alcohol despite being visibly
intoxicated, according to court documents in Texas.
Gordon Savage of Dallas, claims that the W.W. Fairfield’s bar was guilty of negligence.
Savage wants $1 million to cover his medical expenses, and for pain and
suffering. Savage told the court that he started drinking around 6:00
p.m. at the bar located on North Plano Road.
Employees continued to serve him alcoholic beverages until around 2:00
a.m. Savage then tried to drive home drunk. He crashed into a concrete
dividing wall around 3:00 a.m. on the North Central Expressway.
Savage was taken to the Texas Health Presbyterian Hospital, where he was
treated for severe injuries and released. Savage was not charged with
drunk driving.
Savage claims that employees of the W.W. Fairfield’s bar should have
stopped serving him alcoholic drinks as soon as he was visibly
intoxicated as required by law.
Under the Dram Shop law, bars and other drinking establishments can be
held liable for injuries resulting from excessive alcohol consumption.
